Section 01
1. General Terms of Use
1.1 Agreement
These Terms and Conditions, together with our Privacy Policy and the other policies set out on this page (collectively, the “Terms”), form a binding agreement between E-World Information Systems (“Eworld”, “we”, “us” or “our”) and you (“you” or “your”). They govern your use of our website and of the products and services we provide (collectively, the “Services”). By using our website or ordering any Service, you confirm that you have read, understood and accepted these Terms.
1.2 Changes to these Terms
We may revise these Terms at any time. Revisions take effect as soon as they are published on this page. Please review this page from time to time; your continued use of the website or the Services after a change means you accept the revised Terms.
1.3 Your account and information
To use the Services you must provide true, accurate and complete information when you register and keep it up to date afterwards. You are responsible for all activity carried out through your account.
1.4 Information on this website
Neither we nor any third party give any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials on this website or provided through the Services for any particular purpose. Such information may contain inaccuracies or errors, and we exclude liability for them to the fullest extent permitted by law. You use the website and the Services at your own risk and should satisfy yourself that the Services meet your requirements.
1.5 Intellectual property
The content of this website and of the Services is the property of Eworld. Using them does not give you any intellectual property right, title or interest in that content. Unauthorised use of the website or the Services may lead to action against you under these Terms or applicable law.
1.6 Lawful use
You agree not to use the website or the Services for any purpose that is unlawful or prohibited by these Terms, by the laws of India or by any other law that applies to you.
1.7 Third-party websites
The website and the Services may contain links to third-party websites. When you visit them, their own terms of use, privacy policies and other policies apply.
1.8 Orders, payment and refunds
When you place an order for a Service you enter into a legally binding contract with us, and you agree to pay the charges for that Service. If we are unable to provide a Service you have paid for, you are entitled to a refund under our Refund Policy. Refund claims must be raised within the period that applies to the Service concerned; claims raised after that period are not eligible.
1.9 Events beyond our control
Notwithstanding anything else in these Terms, neither party is liable for any failure or delay in performing an obligation where that failure or delay is caused by a force majeure event, including natural disasters, fire, flood, epidemic, war, civil disorder, industrial disputes or acts of government.
1.10 Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or with the Services, are governed by the laws of India. The courts at Kozhikode (Calicut), Kerala, India have exclusive jurisdiction over all such disputes. This clause applies to every policy on this page.
1.11 Contact
Please send any question or notice about these Terms using the details on our Contact page.
Section 02
2. Acceptable Use Policy
By ordering any service from Eworld, you agree to follow this Acceptable Use Policy (the “Policy”).
2.1 Scope
This Policy describes the permitted and prohibited uses of Eworld’s web hosting services as subscribed under your service agreement. It is a guideline rather than an exhaustive list, and we may update it at any time; changes take effect when published on this website.
2.2 What the services provide
Our hosting services allow you to develop, publish and display a website, store data in a database, send and receive email, run interactive features such as forums or bulletin boards, and send and retrieve information.
2.3 Monitoring
We do not monitor or censor the information you publish or collect through the services, apart from routine monitoring of system and network resources. We will, however, act on any breach of this Policy that we discover during that monitoring or that is reported to us. We expect every user to use the internet courteously and responsibly and to follow good internet etiquette.
2.4 Our rights
Eworld may, at its sole discretion, revise this Policy and remove any content from your account, including content that breaches this Policy. This right does not place any obligation on us to monitor or exercise editorial control over the content of your account.
2.5 Prohibited uses
You must not use, or allow anyone else to use, Eworld services to:
- Run software download or distribution sites, or any site created for the mass distribution of software. A site is treated as a software distribution site when 50% or more of its total bandwidth is used for program or binary downloads.
- Run sites that generate system errors or exceptions which disrupt server performance or cause server-wide outages, including by overriding or bypassing the system settings and restrictions of your plan.
- Use server resources (CPU, memory or process time) beyond the limits set out in Section 6.
- Transfer more data than the bandwidth allowed by your plan.
- Breach any applicable law or regulation, whether intentionally or not.
- Impersonate any person or organisation, or misrepresent your connection with any person or organisation.
- Use misleading email addresses or falsify any part of a communication.
- Upload, transmit, store, publish or link to any content that:
- you are prohibited from sharing by law, contract or a fiduciary duty;
- enables hacking or unauthorised access to data, systems, servers or networks, including probing, scanning or testing for vulnerabilities, or breaching security or authentication measures;
- forges TCP/IP packet headers, email headers or any part of a message header, or monitors data or traffic without authorisation;
- interferes with service to any user, system or network, including flooding, deliberately overloading a system, or staging or broadcasting an attack, whether deliberately or through negligence;
- infringes any copyright, trademark, patent, trade secret or other intellectual property or proprietary right;
- is unsolicited advertising or promotional material, spam, chain letters, pyramid or “get rich quick” schemes, or any other form of unsolicited solicitation;
- contains viruses, worms, Trojan horses, time bombs, trap doors or any other code designed to interrupt, damage or limit the functioning of software, hardware or telecommunications equipment;
- is unlawful, harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene or invasive of privacy;
- is adult or pornographic in nature, or harmful to minors;
- promotes illegal activity, offers fraudulent goods, services or schemes, uses false information in any sign-up, contract or registration, or misuses information obtained through the services, including payment card details;
- exploits images of children or discloses personal information about children.
2.6 Consequences of a breach
If Eworld determines, at its sole discretion, that you have breached this Policy, we may terminate your account immediately and without notice, and you may be held liable for any loss or penalty Eworld suffers as a result.
Section 03
3. Refund Policy
This Refund Policy explains when refunds are available for Eworld hosting and domain services. By ordering any of our services you confirm that you have read and accept it.
3.1 New accounts
- Web hosting: every new web hosting account carries a 30-day money-back guarantee. If you are not satisfied with our service within the first 30 days of an active account, we will refund your payment in full, less the 10% payment-gateway charge if you paid online, unless different terms were stated at or before purchase. You must tell us you wish to cancel before the 31st day of your contract.
- Domain names: domain registrations are final once purchased. You become the sole owner of every domain registered through us when it is paid for in full. Because domains can be transferred to another provider at any time, they are not refundable.
3.2 Reseller accounts
- Reseller hosting: new reseller hosting accounts carry the same 30-day money-back guarantee, on the same terms as new hosting accounts in 3.1.
- Domain names: as set out in 3.1, domain registrations are final and not refundable.
- Domain reseller accounts: the available debit balance in your account will be refunded, provided no funds are locked at the time you request the transfer.
3.3 Renewals
- Hosting renewals: a refund is available if you request cancellation no later than 10 days after the renewal date. No exceptions are made to this period.
- Domain renewals: Eworld never renews a domain automatically. We notify you before your domain’s expiry date, and it is your responsibility to renew it through your control panel and billing account. Domain renewals are not refundable under any circumstances.
3.4 How refunds are paid
Refunds are made by the same method you used to pay the invoice. They are paid in full, except that the 10% card-processing charge is deducted from card payments and domain charges are non-refundable.
Section 04
4. Privacy Policy
4.1 Information we collect
We collect the personal information you submit to us, including contact and billing details and payment information, for our records and to bill you for the Services.
4.2 How we use and protect it
All such information is kept strictly confidential. It is used only by Eworld, our authorised representatives and our employees, only for the purpose for which it was provided, and for your benefit as our client.
4.3 Disclosure
We do not share, rent, sell or release your information to any individual, organisation or third party for any reason without your specific written consent, except where we are required to do so by law, regulation or a government authority, or where it is needed to investigate alleged abuse of our services or infringement of copyright or other rights.
4.4 Questions
If you have any question about the information we hold about you, please contact us.
Section 05
5. Disclaimer & Limitation of Liability
Eworld hosts websites for many clients, which means we have a responsibility to protect each of them and to provide the best service we can. That service has limits, which are set out below.
5.1 Limitation of liability
Eworld is not responsible for any claimed damages, including incidental and consequential damages, arising from our servers going offline or being unavailable for any reason, or from the corruption or deletion of any website on our servers. In every case our liability is limited to the immediate termination of the affected service.
5.2 Enforcement of our policies
- Eworld is the sole judge of what does and does not breach our Acceptable Use Policy.
- We may terminate any account, at any time, that causes harm to other customers’ websites.
- We may delete all content and files when an account is terminated.
- We may withhold any prepaid fees for a website removed for breaching these policies.
- We may refuse, cancel or suspend service at our discretion.
5.3 Changes and reporting abuse
We may change these policies without prior notice. If we do not enforce any part of them, that does not amount to consent or a waiver. Please review this page regularly for changes. Report any breach of these policies to abuse@eworld.co.in; every complaint is investigated promptly.
5.4 Your website content
You are solely responsible for providing, uploading, updating and maintaining your website or server and everything on it or transmitted through it, including files, pages, data, text, images, graphics, audio, video, email, meta tags, trade or service marks, software and domain names registered by you or on your behalf. You are also responsible for making sure your content is compatible with the hardware and software we use to provide the Services; Eworld is not responsible for any damage, malfunction or interruption caused by an incompatibility. While giving you technical assistance, our support staff may need to modify, alter or remove content in your hosting account.
5.5 Backups and data security
You are solely responsible for protecting your website and data. In particular, you must:
- take measures to prevent loss of or damage to your website or server content;
- keep your own independent, up-to-date backups of your site files, databases and email; and
- maintain the security, confidentiality and integrity of all content you transmit to or store on our servers.
You can back up and restore your files and your entire account from your control panel (cPanel), and export or import MySQL databases with phpMyAdmin. We recommend a remote backup solution. To keep storage free for all users, backup archives must not be stored on the server; download any backup you generate within 24 hours.
Eworld takes weekly backups and can restore web, email and database content from them on request. These backups are a courtesy and must not be relied on as your only copy. We cannot guarantee recovery after data corruption or system failure, and we are not responsible for loss or modification of data caused by hacking, illegal activity, or hardware or software failure. If an account is suspended or terminated for breach of these Terms, we may be unable to provide its files.
In the event of a major, unrecoverable server failure, Eworld will provide an alternative hosting arrangement within 24–48 hours.
Section 06
6. Web Hosting Service Terms
Our shared hosting servers are used by many customers, and every customer is entitled to a fair share of their resources. The rules below protect that fair share. Breaking them can lead to suspension of your account, but we will always try to work with you to keep your account within these terms.
6.1 Scripts
Any script that poses a security risk or harms server performance or network integrity will be stopped or removed without prior notice. Scripts may not be shared with domains not hosted by Eworld, and scripts that can be abused to send unsolicited commercial email are not permitted.
6.2 “Unlimited” space and bandwidth
Our shared and reseller plans are sold as “unlimited” so that legitimate customers do not need to count disk space, bandwidth, databases or other individual resources. Shared hosting is still a shared environment, however, and unlimited plans are intended for normal website use. They may not be used for:
- file upload, file sharing, archive, backup, mirroring or distribution sites;
- sites created mainly to drive traffic to another site;
- making your account’s resources available to the public, whether free or paid; or
- online backup or storage of media such as movies, music or photos.
Each account starts with a set allocation, which we will increase on request as your needs grow. If your usage puts the stability, performance or uptime of our servers or network at risk, we may restrict your resources or ask you to upgrade to a VPS or dedicated server. Using hosting space for storage or backup is a breach of these terms and will lead to suspension without prior notice.
6.3 Software and multimedia distribution
Web hosting and e-commerce accounts are not set up for distributing software or multimedia. File sharing, torrents, warez and pirated material are prohibited. Accounts may not be used primarily to store or distribute multimedia files (graphics, audio and video); such files will be deleted and the account may be suspended.
6.4 CPU and memory limits
Each account may use up to 10% of server CPU and memory, and no process or session may run for more than 10 minutes. This applies to all database use, email, cron jobs and FTP sessions.
6.5 Email sending limits
Outgoing email is limited to 200 messages per hour or 2,000 per day per hosting account, whichever is reached first.
6.6 Spam
Sending unsolicited bulk or commercial email (“spam”) is prohibited, whether or not it overloads a server or disrupts service. Spamming also includes running an open SMTP relay, sending spam through another provider that advertises a website hosted on an Eworld server, and selling or distributing spamming software from a website hosted with us. Breaches lead to immediate suspension. Eworld alone decides what constitutes a breach of this clause.
6.7 Payment due dates
If payment is not received by the due date, the hosting account is suspended the following day and terminated 7 days after the due date, unless a hold has been agreed with us.
6.8 Delivery of services
We aim to deliver every service as soon as your sign-up is complete. If we cannot, we will let you know by email, telephone or both. As soon as your payment succeeds you will receive an automated receipt showing your unique customer username. Please keep it safe and quote that username in all enquiries to Eworld.
Section 07
7. Website Project Terms
This section applies to the project services Eworld provides, including website design and development, internet marketing, mobile application development, content development, and maintenance and support (the “Project Services”), to the customer who orders them (the “Client”). It applies together with the rest of these Terms and any Service Level Agreement (“SLA”) agreed for the project.
7.1 Scope of services
Unless we state otherwise, any new feature that adds to or improves the Project Services forms part of them. Eworld may modify, suspend or discontinue the Project Services, in whole or in part, at any time and without notice if the Client fails to co-operate, fails to pay, or causes unreasonable delay. The Client agrees that neither the Client nor any related third party will hold Eworld or its suppliers liable for any loss, damage or consequence of such a modification, suspension or discontinuation.
7.2 Quotations and acceptance
- Every estimate or quotation is based on our understanding of your requirements and the agreed timeframe. Any change to the functionality, including small improvements, may cost extra.
- You accept a quotation, and these Terms, by confirming it verbally or by email, by paying the initiation fee, or by signing it.
- Before accepting, please make sure the quotation covers all of your requirements and that we have understood them fully. Give us clear guidelines, including the flow and any specific details you need. Where details are not provided, we will quote and proceed on our own understanding, and changes needed later to resolve a discrepancy may cost extra.
- Any complexity in a particular task must be raised in advance so that it can be included in the proposal and priced. We quote in good faith and rely on you to give us the full picture; Eworld does not bear the cost of discrepancies caused by unclear requirements.
7.3 Timelines, changes and additional work
- Each project has a limited allocation of working hours. Minor changes may be accommodated within that allocation, decided case by case.
- We make every effort to complete the project and any changes within the agreed timeframe. Reasonable delays are to be expected if functionality is redefined or modified.
- You must provide the website or application content and all related materials. Delays on your side, including late content, may extend the timeline and, if they go beyond a reasonable period, may lead to additional charges.
- Rework of a completed task, design changes after the design has been approved, and changes requested during development or after Go-Live approval are charged separately, as is any other work beyond the estimate. Eworld is not liable for delays caused by changes to the project brief.
- If a project is stalled for more than two calendar months at any stage, the approved estimate may increase. To put a project on hold without extra charges, tell us in writing in advance and bring your account up to date for the work completed.
- Unforeseen circumstances, particularly the integration of third-party software, can occasionally delay development. Provided we have made every effort to keep to the agreed schedule and the delay is reasonable, you agree not to penalise us for a genuine delay.
7.4 Bug fixes
Programming errors (bugs) reported during development or immediately after it are fixed at no additional charge.
7.5 Testing and compatibility
- Websites and applications are tested on PCs using a recent version of Google Chrome, and responsive pages are tested on Android phones. If you need testing on other browsers or devices, please tell us in advance.
- Websites and applications are built to run on a commercial-grade web server or equivalent. Depending on your traffic, they may not perform as intended on a general office network.
7.6 Hosting, domains and third-party components
- Domain registration and renewal, and hosting, are not included in any quotation unless stated. If you need them, we will quote separately for your approval.
- If you arrange your own hosting, please consult us before choosing the type of hosting and database, as they must meet the requirements of the technology used. We will need full access, with support from the hosting provider, to test and deploy the project. Eworld is not liable for delays or errors caused directly or indirectly by the hosting company, and extra hours spent on server or network issues with hosting not provided by Eworld are charged separately.
- Some projects need third-party components such as payment gateways or SSL certificates. We do our best to confirm they are suitable, but their limitations are outside our control. Purchase costs for third-party items, such as SSL certificates, payment gateways, Google Ads, plugin licences and images, are not included in our quotations.
- Eworld is not responsible for open-source products such as WordPress, Joomla or open-source shopping carts. Keeping all components and third-party software up to date is your responsibility, and we recommend regular backups to avoid disruption.
- Some packages are offered with third-party providers. Changes to their rules and policies may affect our services or these Terms.
7.7 Approval, go-live and handover
We generally build and test projects on our own servers. The finished design and programming are presented on a demo server for you to check and approve before they are moved to the live server, so please check all functionality carefully at that stage. Design or programming changes requested after approval and go-live are charged according to the work involved. The website or application can be transferred to a third-party server you nominate once all invoices and dues have been paid in full.
7.8 Ownership and intellectual property
Who owns the finished work depends on the type of service:
- Websites and other services – no lock-in: for website design and development, internet marketing, content and all other services, the Client owns the delivered work once all invoices are paid in full. This includes the website’s design, content, graphics, text, images and the code written specifically for it, together with the Client’s domain names, data and accounts. The Client is free to move the website to any host or provider. Third-party and open-source components remain subject to their own licences.
- Eworld software products: software products developed and owned by Eworld, including Eworld CMS and other proprietary applications, remain the copyright and intellectual property of Eworld. The Client receives a licence to use them for its own business for as long as the applicable fees are paid, including hosting fees where the product is hosted by Eworld. Unless agreed otherwise in writing before the project starts, the source code is not handed over and the software may not be transferred to an external host, resold or duplicated.
7.9 Communication
Project communication is normally by email. Please keep us informed of your current email addresses.
7.10 Disputes
In the event of a dispute, Eworld may charge the Client in full for the work done and for the resources spent managing the dispute, without applying any discounts previously given in good faith. Eworld is not liable for any damages arising from misrepresentation or misinformation, and may refuse service to any client whose requirements are not consistent with our business principles and policies.
7.11 Security and liability
Eworld provides its Project Services on an “as is” basis, without guarantees against security issues or resulting loss of data, sales or reputation. We do our best to protect our systems and servers from hackers, viruses, intruders and other online and offline threats, but we are not liable for any disruption of service if such a problem occurs.
7.12 Independent relationships
Eworld’s relationships with its suppliers, partners and subcontractors are independent. None of them has any power or authority to bind another, or to create any obligation, express or implied, on another’s behalf or in another’s name.
7.13 Indemnity
The Client will indemnify and hold harmless Eworld and its licensors, content providers, service providers, employees, agents, officers, directors, contractors and subcontractors (the “Indemnified Parties”) against any breach of these Terms or of any other policy referred to in them, including any use of content not expressly authorised by these Terms. The Indemnified Parties have no liability for any such breach or unauthorised use, and the Client will indemnify them against all resulting losses, damages, judgments, awards, costs, expenses and legal fees. The Client will also indemnify the Indemnified Parties against any third-party claim arising from the Client’s use of information obtained from Eworld.
7.14 Events beyond our control and governing law
Eworld is not liable for any breach caused by events beyond its reasonable control, as described in clause 1.9, including lightning, explosion, pandemic, earthquake and extremely severe weather. Project agreements are governed by the laws of India and subject to the exclusive jurisdiction of the courts at Kozhikode (Calicut), Kerala, as set out in clause 1.10.
